STAGING TERMS FOR VACANT ORDER FORM

FINANCIAL TERMS

• INITIAL STAGING CHARGE: I understand and agree to allow Lionheart Home Staging to charge my credit card for the staging project, requested Add-Ons and photography, taxes, and any applicable fees when I submit my Vacant Staging Order Form. I understand that if Lionheart sends an invoice for the staging project, I agree to pay the invoice within 14 days of the staging date.
• MONTHLY STAGING RENTAL: I understand and agree that Lionheart will charge or invoice a monthly staging rental if I do not give them notice to discontinue staging services prior to the expiration date. I agree to allow Lionheart to continue to charge my card or invoice me monthly on the expiration date until notification is given to discontinue staging services. I understand that there are no refunds or prorating with the monthly staging rental once it has been charged on my card or invoiced, and I am responsible to pay the Monthly Staging Rental in full.
• NON-REFUNDABLE STAGING DEPOSIT: I understand and agree that Lionheart will charge a non-refundable staging deposit of 25% of the total staging cost if they need to special order furniture for my staging project and/or if the project total exceeds $4,000.00. This deposit will be charged on the day the staging confirmation is sent, and the balance will be charged on the staging day.
• DESTAGING NOTIFICATION: I understand and agree to give Lionheart Home Staging at least 7 days notice for single family homes (within the metro) and 14 days notice for condos, long distance projects, or whole house stages to allow them to time to make arrangement on their moving schedule. I understand that if notice is given after the expiration date, I will pay the renewal for that month.
• EMERGENCY DESTAGING PRIOR TO CLOSING: I understand and agree that I will pay Lionheart Home Staging by credit card (automatically charged) or invoice a $250 EMERGENCY DESTAGING FEE if the removal of a stage is needed within 7 days from notification.
• EMERGENCY DESTAGING AFTER CLOSING: I I understand and agree that I will pay Lionheart Home Staging by credit card (automatically charged) or invoice a $500 EMERGENCY DESTAGING FEE if the property closes prior to destaging due to insufficient time notice (see destaging notification above). I understand that I am financially responsible for any lost, damaged, and/or missing Lionheart inventory at replacement value if destaging is performed after the new owner takes ownership or the new owner will not allow Lionheart access to the property.
• LOCKOUTS & NON-ACCESSIBLE PROPERTIES: I understand and agree that I will pay Lionheart Home Staging by credit card (automatically charged) or invoice a $250 LOCK-OUT FEE due to missing/incorrect keys, incorrect lockbox code, contractors blocking staging areas, un-shoveled driveways and sidewalks, or other blockage that prevents our truck from parking close to the property and/or our movers to safely traverse walkways and/or safely installing/removing the stage on the scheduled staging/destaging days. I understand that I will be charged/invoiced an additional $250 RESCHEDULING FEE if the Lionheart Moving Team has to schedule staging/destaging on a different day.
• SOLE RESPONSIBILITY: I understand and agree that I am solely responsible for the staging costs, renewal charges, and assessed fees as indicated in the Staging Terms and the corresponding Staging Quote and/or agreed upon pricing.  I understand that if any party is partially or wholly financially responsible, they will need to submit their own Vacant Staging Order Form to Lionheart Home Staging and indicate their responsibility in the NOTES portion of the order form.
• UNPAID BALANCES: I agree to be responsible for all costs associated with collecting an unpaid balance from staging services, rentals, missing, damaged, or stolen inventory.
• OWNER PERMISSION: I agree that I am taking responsibility for staging costs and for Lionheart's inventory while it remains at the property. If I am not the owner, I understand that I need to receive the owner's permission prior to ordering staging from this property.

CANCELLATION & RESCHEDULING POLICY:

• CANCELLATION POLICY: I understand and agree that I will be charged or invoiced a $300 Cancellation Fee if a staging project is cancelled within 48 hours of the staging date to compensate for the preparation time for the project.
• RESCHEDULING POLICY: I understand and agree that my staging project projects can be rescheduled up to 24 hours prior to the staging dated without a fee. If the project is cancelled thereafter, a $300 Cancellation Fee will be charged. Once the stage is loaded onto the truck and the project is cancelled, I understand and agree that I will be charged or invoiced a $300 Rescheduling Fee.

CLIENT PERMISSIONS

• I grant Lionheart Home Staging permission to enter the specified property for the purpose of providing staging services which include: quoting, delivery, set-up, photographing, pre-packing, destaging, and other staging services. I understand that the staging project may be pre-packed for Lionheart’s Moving Team the day before the destaging occurs.
• I grant Lionheart Home Staging permission to use nails, hooks, or other materials necessary to hang or display home accents for staging purposes. I understand that Lionheart has no responsibility to patch holes, pain, and do other touch up work as a result of hanging art or other staging processes.  I understand that it is my responsibility to notify Lionheart on the Vacant Staging Order Form if I do not want any art work hung on the walls.
• I grant Lionheart Home Staging and/or their contracted professional photography company permission to photograph and video record staged and surrounding areas for marketing, educational, and listing purposes. I understand that Lionheart may need to share lockbox or other access codes to allow a professional photographer to enter the property. Lionheart agrees to keep all my personal information confidential.

CLIENT RESPONSIBILITIES

• I will give Lionheart Home Staging a key, garage code, or lockbox code to perform staging duties. I understand that I must notify Lionheart if the code changes or the lockbox is moved to another location. If a lockout occurs for the Lionheart Team or their contracted photographer, I accept responsibility for a rescheduling charge of $300.
• I will keep the entrances of the property unobstructed during the furniture delivery, staging, and destaging process. I am responsible for removal of snow and ice on the driveway and sidewalks during the winter months. I assume responsibility for any accidental injuries as a result of slippery or obstructed walkways. Lack of access into the property for staging services, delivery, or pick up for any reason will result a delay of services and an additional rescheduling fee of $300.
• I will have the property cleaned prior to Lionheart Home Staging's arrival. I understand that a cleaning fee will be charged to my card if Lionheart's furniture and decor are used, soiled, or covered with contractor debris or dust (up to $500). I understand that a RESCHEDULING FEE of $250 will be applied if the property is not ready for staging.
• I will have all contractors, workers, realtors, and myself vacate the property while the Lionheart Staging Team is delivering, installing and/or picking up the stage, unless otherwise specified and agreed to by Lionheart. Obstruction to staging services through people who are on site will result in a delayed or cancelled staging date and a RESCHEDULING FEE of $300.
• I will keep the entire stage (furniture and accessories) at the address (including unit number) in which the Lionheart Staging Team installed. I understand that moving Lionheart's property from the original address to a new location violates our Staging Terms and will result in an additional full staging charge.
• I will keep Lionheart's furniture and accessories in their installed place within the property. I exempt Lionheart Home Staging from any and all damage caused by someone using or moving Lionheart's furniture or accessories from their original location after the staging installation has been completed.
• I will assume responsibility for any damage or soiling to Lionheart's furniture and accessories as the result of on-site contractors, workers, cleaning personnel, realtors, or other visitors. I acknowledge I will be charged any cleaning fees, repair fees, or full replacement value for any item that is beyond repair.
• I will assume responsibility for theft of Lionheart furniture and accessories while the stage is at my property. I acknowledge I will be charged full replacement value for any stolen or missing staging furniture and accessories.
• I I will allow Lionheart to move personal belongings that remain at the property to a discreet area of the home while staging services are being performed. Lionheart has the right to refuse to move any item left in the property by the seller that is too heavy, delicate, or of great value as Lionheart does not take responsibility for damage occurring.

CLIENT RESPONSIBILITIES

I agree to all of the following:
• I exempt Lionheart from any damage or crumbling to plaster walls during the course of hanging or removing staging props due to the instability of this type of material. I understand that it is my responsibility to notify Lionheart if I do not want any nail holes in the walls. I exempt Lionheart from liability due to floors fading and/or discoloration due to rugs, furniture, and inventory sitting in direct sunlight.
• I limit Lionheart Home Staging total liability to a refund of the staging fees that have been paid.
• I will keep the home unoccupied during the use of Lionheart inventory property unless otherwise agreed upon and signed. Violation will result in immediate cancellation of this Agreement and removal of all furniture and decor without a refund. A cleaning fee will be charged. The signer will be responsible for the full replacement value of used bedding, mattress, linens, pillows, soft goods, and any other damage or deterioration caused by use.
• I will be liable for cleaning fees or replacement value to damage or soiling due to pests, bugs, mice, rats, and other rodents that damage Lionheart inventory..
• I exempt Lionheart Home Staging, from delayed staging or pick up due to inclement weather, equipment/truck failure, or sudden stager/movers illness or accident.
• I agree to pay all collection services, legal fees, and court costs associated with attempts to collect on delinquent payments from staging services and/or fees rendered or for violation of the staging terms.



CREATIVE CONTROL UNDERSTANDING:

I agree to and understand the following:
• When I hire Lionheart Home Staging, INC for their Vacant Staging Services, I fully relinquish creative control to the Lionheart Staging Team.  I understand that although I may submit a request, the final staging design, furniture, art, and accessory selection and placement are up to the discretion of Lionheart's trained professionals.  Lionheart has no obligation to exchange, and/or add, and/or remove furniture, art, or accessory pieces once it is delivered to the property.  I understand that if I, my listing agent, or another person moves any part of the stage once it is in place, that I may be violating the staging terms as outlined in the CLIENT RESPONSIBILITIES portion of these terms, and Lionheart has the option to cancel the staging contract with no refunds.  I also understand that Lionheart's staging may not necessarily suit my taste or style, as their goal is to appeal to a specific buyer demographic.

STAGING CONSULATIONS:

I agree to:
• Allow Lionheart to charge my card for the submitted staging consultation. I understand that my card will be charged when when the Order is placed. CANCELLATION POLICY: Refunds are given (minus $25 admin and credit card processing fees).
